These terms apply to your use of 820visa.com.au. If you do not accept them, do not use the site.

General information only

Everything published here is general information about the Australian onshore partner visa — the temporary subclass 820 and the permanent subclass 801. It describes how the rules work. It does not take account of your visa history, your relationship, your sponsor, your documents or anything else particular to you, because none of that is known here.

Nothing on this site is legal advice or migration advice. 820visa.com.au is not a law firm and not a migration practice. No immigration assistance is given through this site. Advice on your own visa application is immigration assistance under s 276 of the Migration Act 1958, and it should come from an Australian migration lawyer; an unregistered agent who gives it breaks s 280. In a difficult case an application a lawyer prepares is more likely to succeed. What a migration lawyer does, and how to check one, is on working with a migration lawyer.

No client relationship

Reading this site, using its search, or sending a message through the enquiry form does not create a client relationship, a retainer, a duty of care or any professional engagement. No confidentiality or legal professional privilege attaches to a message sent through the form.

If you ask to be put in touch with an Australian migration lawyer, any engagement that follows is between you and that person, on terms you agree with them directly, and this guide is not a party to it.

Accuracy and currency

The site is written from Australian government sources and each page carries the date it was last reviewed, as explained on how this guide is researched. Even so, migration law changes, often at short notice. Regulations are amended, visa application charges are indexed, ministerial directions are replaced, and the Department of Home Affairs rewrites its own pages. A page that was accurate on the day it was reviewed can be overtaken without warning.

No warranty is given that the content is complete, current, accurate or fit for any particular purpose. Before you act on anything you read here, check the Department's current material for your visa subclass, and get advice about your own circumstances.

Figures that move — charges, processing times, fees — are dated in the text where they appear. A dated figure records what a government page showed on that date and nothing more.

Your own decisions

Decisions about a visa application are yours, and their consequences are yours. To the extent the law allows, no liability is accepted for any loss, cost or damage arising from the use of this site or from reliance on anything published on it, including an application that is refused, invalid, delayed or lodged out of time.

Where consumer guarantees under Australian law cannot be excluded, nothing in these terms attempts to exclude them.

Common questions

Is anything on this site legal advice?

No. Every page is general information about how the subclass 820 and 801 visas work. It does not take account of your visa history, your relationship, your sponsor or your documents, and it is not advice about your own situation. Advice on your own application is immigration assistance under s 276 of the Migration Act 1958; get it from an Australian migration lawyer.

Does sending a message through the form make me a client?

No. Using this site, reading it, or sending a message through the enquiry form does not create a client relationship, a retainer or any professional engagement. If you ask to be put in touch with an immigration lawyer, any relationship you go on to form is with that person, on terms you agree directly with them.

Can I copy pages from this site?

You can read, print and share links freely, and quote short passages with a credit and a link back. The words, structure and design of this site are protected by copyright and may not be republished in bulk, scraped or reproduced as someone else's content. Australian government material quoted here remains subject to the terms the relevant department applies to it.

What if something on the site turns out to be wrong?

Report it through the contact form and it will be corrected. Beyond that, the site is provided as general information without any warranty that it is complete, current or suited to your circumstances, and no responsibility is accepted for decisions made in reliance on it. Check the Department of Home Affairs' current material and get advice before you act.
